\/>\n<b>Accepter la critique, refuser les abus et \u00e9viter les <i>\u00ab&nbsp;bad buzz&nbsp;\u00bb<\/i><\/b><\/span><\/span><\/p>\n<p>D\u00e9ployer sa r\u00e9putation sur Internet, c&#8217;est aussi prendre le risque, et accepter, de s&#8217;exposer \u00e0 la critique.<\/p>\n<p>Etre libre de s&#8217;exprimer ne signifie pas pour autant que l&#8217;on puisse dire tout et n&#8217;importe quoi&nbsp;: Si la libert\u00e9 d&#8217;expression reste de mise, l&#8217;abus du droit de critique est sanctionn\u00e9.<\/p>\n<p>Or, la fronti\u00e8re entre la libre critique et les avis susceptibles d&#8217;\u00eatre condamn\u00e9s sur un plan civil ou p\u00e9nal n&#8217;est pas toujours ais\u00e9e \u00e0 d\u00e9limiter ce d&#8217;autant que le juge, dans son appr\u00e9ciation, prendra le plus souvent en compte la qualit\u00e9 de l&#8217;auteur de l&#8217;avis litigieux (simple consommateur ou journaliste professionnel) en privil\u00e9giant, pour le premier, la libert\u00e9 d&#8217;expression.<\/p>\n<p>C&#8217;est pourquoi, les professionnels doivent \u00eatre accompagn\u00e9s et conseill\u00e9s dans le souci d&#8217;opter pour une r\u00e9ponse gradu\u00e9e et d&#8217;\u00e9viter, par la m\u00eame, l&#8217;effet dit \u00ab&nbsp;Streisand&nbsp;\u00bb, ph\u00e9nom\u00e8ne internet qui se manifeste par une augmentation consid\u00e9rable de la diffusion d&#8217;un contenu que l&#8217;on cherchait initialement \u00e0 censurer.<\/p>\n<p><b>Quelle \u00ab&nbsp;boite \u00e0 outils&nbsp;\u00bb pour les professionnels&nbsp;?<\/b><\/p>\n<p>La pratique des faux avis constitue une pratique commerciale d\u00e9loyale et trompeuse au sens des articles L. 120-1 et 121-1 du Code de la consommation, \u00e0 savoir une pratique commerciale contraire aux exigences de la diligence professionnelle et qui alt\u00e8re, ou est susceptible d&#8217;alt\u00e9rer de mani\u00e8re substantielle le comportement \u00e9conomique du consommateur normalement inform\u00e9 et raisonnablement attentif et avis\u00e9.<\/p>\n<p>C&#8217;est d&#8217;ailleurs sur ce fondement que le Tribunal de grande instance de Paris a condamn\u00e9 le 20 juin 2014 une soci\u00e9t\u00e9 gestionnaire d&#8217;un site d&#8217;avis \u00e0 7.000 euros d&#8217;amende et son g\u00e9rant \u00e0 3.000 euros, pour avoir r\u00e9dig\u00e9 et publi\u00e9 de faux avis de consommateurs.<\/p>\n<p>Les avis diffamatoires ou injurieux pourront quant \u00e0 eux \u00eatre supprim\u00e9s sur le fondement de la loi du 29 juillet 1881 sur la libert\u00e9 de la presse, \u00e9tant pr\u00e9cis\u00e9 que la diffamation correspond \u00e0 l&#8217;all\u00e9gation ou l&#8217;imputation, d&#8217;un fait pr\u00e9cis et non av\u00e9r\u00e9, portant atteinte \u00e0 l&#8217;honneur ou \u00e0 la consid\u00e9ration d&#8217;une personne physique ou morale d\u00e9termin\u00e9e ou d\u00e9terminable et que l&#8217;injure vise toute expression outrageante, termes de m\u00e9pris ou invective qui ne renferme l&#8217;imputation d&#8217;aucun fait.<\/p>\n<p>Il sera toutefois, dans les deux cas, n\u00e9cessaire d&#8217;agir vite, la r\u00e9pression des d\u00e9lits de presse \u00e9tant enferm\u00e9e dans un d\u00e9lai de prescription extr\u00eamement court de trois mois \u00e0 compter de la publication.<\/p>\n<p>Les avis d\u00e9nigrants qui, \u00e0 la diff\u00e9rence de la diffamation et de l&#8217;injure, concernent uniquement un produit ou un service, pourront, pour leur part, \u00eatre sanctionn\u00e9s sur le fondement de l&#8217;article 1382 du Code civil.<\/p>\n<p><b>Obtenir la suppression d&#8217;un avis illicite aupr\u00e8s de l&#8217;h\u00e9bergeur<\/b><\/p>\n<p>Pour obtenir la suppression d&#8217;un avis illicite diffus\u00e9 sur internet, la premi\u00e8re d\u00e9marche consiste \u00e0 signaler ce contenu au site qui le relaie en ayant recours aux dispositions de la loi du 21 juin 2004 pour la confiance en l&#8217;\u00e9conomie num\u00e9rique.<\/p>\n<p>Cette loi, tout en posant le principe d&#8217;une responsabilit\u00e9 all\u00e9g\u00e9e et \u00ab&nbsp;a posteriori&nbsp;\u00bb des h\u00e9bergeurs, a instaur\u00e9 une proc\u00e9dure de notification aux h\u00e9bergeurs de contenus illicites.<\/p>\n<p>Ainsi, si les h\u00e9bergeurs ne sont pas soumis \u00e0 une obligation g\u00e9n\u00e9rale de surveillance des contenus qu&#8217;ils stockent, leur responsabilit\u00e9 pourra \u00eatre engag\u00e9e si, d\u00e8s le moment o\u00f9 ils ont eu connaissance de leur caract\u00e8re illicite, ils n&#8217;ont pas agi promptement pour les retirer.<\/p>\n<p>Notons toutefois que la victime devra observer scrupuleusement le formalisme rigoureux impos\u00e9 par la loi.<\/p>\n<p>Les professionnels devront donc veiller \u00e0 se faire assister dans de telles d\u00e9marches ce d&#8217;autant, que l&#8217;abus de l&#8217;envoi d&#8217;une notification de retrait de contenus illicites est sanctionn\u00e9 p\u00e9nalement par un an d&#8217;emprisonnement et 15.000 euros d&#8217;amende.<\/p>\n<p><b>Identifier l&#8217;auteur des contributions<\/b><\/p>\n<p>Afin de faciliter l&#8217;identification des auteurs d&#8217;une infraction, la loi sur la confiance en l&#8217;\u00e9conomie num\u00e9rique impose aux fournisseurs d&#8217;acc\u00e8s \u00e0 internet et h\u00e9bergeurs, de conserver les donn\u00e9es <i>\u00ab&nbsp;de nature \u00e0 permettre l&#8217;identification de quiconque a contribu\u00e9 \u00e0 la cr\u00e9ation du contenu ou de l&#8217;un des contenus des services dont elles sont prestataires&nbsp;\u00bb<\/i>.<\/p>\n<p>L&#8217;autorit\u00e9 judiciaire peut ainsi requ\u00e9rir la communication de ces donn\u00e9es soit \u00e0 la demande d&#8217;un tiers (via une action en r\u00e9f\u00e9r\u00e9 ou une ordonnance sur requ\u00eate), soit dans le cadre d&#8217;une enqu\u00eate judiciaire men\u00e9e par les services de police ou de gendarmerie.<\/p>\n<p><b>Vers un nouvel encadrement juridique&nbsp;?<\/b><\/p>\n<p>Le projet de loi d&#8217;Axelle Lemaire \u00ab&nbsp;pour une R\u00e9publique num\u00e9rique&nbsp;\u00bb, en son article 21,&nbsp;pr\u00e9voit \u00e0 la charge des responsables de plateformes d&#8217;avis de consommateurs une obligation d&#8217;information renforc\u00e9e, notamment sur l&#8217;existence ou non d&#8217;une v\u00e9rification des avis et le cas \u00e9ch\u00e9ant des modalit\u00e9s d&#8217;un tel contr\u00f4le.<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\"
